Why Is Obamacare Unconstitutional – Three Reasons Why the Law Should Be Struck Down

Why is Obamacare unconstitutional?  The Supreme Court is listening to arguments about the constitutionality of the new law today, and millions of Americans are anxiously waiting to hear their opinion.  It has been two years since the Patient Protection and Affordable Care Act was passed into law, and Americans will feel the full effects of the new law in 2014.  Unless a Republican is elected President at the end of 2012, or the Supreme Court strikes down the individual mandate, all Americans will be required to purchase health insurance beginning in 2014.  Will we soon learn why Obamacare is unconstitutional, or will everyone be forced to buy healthcare coverage?

Here are my answers to the question of why is Obamacare unconstitutional:

It forces citizens to buy coverage.  

Under Obamacare, citizens are forced to buy health insurance.  Many employers already provide healthcare coverage to their employees, but presently most employees pay for a portion of their insurance.  Some people elect not to purchase healthcare from their employer to save money, but they will have to have insurance under the new laws.  Other people don’t have insurance because they don’t have a job.  Proponents of the new healthcare laws argue that everyone should be able to get the care they need, but the fact is that no one can be refused care if they go to the emergency room.

If the citizens of the United States are forced to buy healthcare, then they can be forced to buy anything.  The government could realistically force people to go to the dentist twice a year or change their oil every 3,000 miles if they can force Americans to buy health insurance.  Having an individual mandate that requires consumers purchase health coverage provides lawmakers with a slippery slope to require other purchases from citizens too.

The country can’t afford Obamacare

The costs of providing care to everyone will drastically increase the costs of healthcare.  This has been well documented by several agencies.  The Congressional Budget Office (CBO) now states the new law is actually going to cost $1.76 trillion dollars to implement.  Originally they estimated it would cost $940 billion to implement, so this is a huge increase from the initial estimates of the bill.  Even at a price tag of $940 billion, the costs associated with this bill threaten to devastate the American economy.

There are numerous small business owners around the country who have stated they will have lay off employees if they are required to provide healthcare to all of their employees.  Healthcare costs are already skyrocketing because insurance companies will have to provide coverage to everyone now, and that means they must significantly raise their rates to keep up with the expected increased costs of providing service for everyone.  These costs must be passed on to the employers, and many smaller businesses are finding it is cheaper to pay the penalty for not providing insurance than to provide insurance for all of their employees.

The government fails at running the post office, social programs and everything else. 

One of the biggest issues I see is that the Government can’t run the post office, social security, or the welfare system without massive waste and frivolous spending, so why would anyone want the government running the healthcare industry?  The public schools of the USA are lagging behind many other countries, so why does anyone think that the government will do a better job of handing healthcare than the companies who have provided healthcare for over 100 years?

Why is Obamacare unconstitutional?  I believe it is simply because the Federal government cannot issue a mandate that forces citizens to buy any product or service.
